The tariff case is, at least in the first instance, a statutory interpretation case, not a constitutional one in the way many think.  Trump has identified language in a federal statute that he claims authorizes the tariffs.  The Court will decide whether he is right about that statutory interpretation, So, the primary question isn't whether the Supreme Court will "defer" to Trump nor is it whether Article II authorizes the President to impose tariffs.  Rather, it is whether, under the circumstances as they exist today, Congress has already given that authority to the Executive Branch via a statute.  So, the tariff case is closer to Biden v. Nebraska than it might appear. 

 

A secondary question in the case, which will only arise if the Court concludes that Trump's statutory interpretation is correct, is whether the statute (as interpreted) unconstitutionally delegates legislative power to the President.  The non-delegation doctrine on which that question is based is quite controversial and has a checkered history.  It's main modern proponents are actually conservatives, e.g., Kavanaugh, and the liberal justices have been typically rejected it.  

 

In sum, this is not a case in which the President claims to be acting on his own inherent Article II authority without the consent or authorization of Congress.  Rather, it's one in which there is a dispute about whether Congress has already delegated certain discretion to the President.  (Having read Youngstown Steel, you know the importance of whether a statute has authorized the President's actions.)

My prediction is that Trump loses on the statutory interpretation question, and thus the Court never reaches the constitutional non-delegation question.

People want freedom of speech, except when it shouldn't apply around them.  Can you have true freedom of speech with any level of censorship?  Not really.  But at the same time, if someone else's freedom of speech suppresses the rights of someone else, then yes, I think a level of censorship should exist.  But that's a very fine line!  It's why it's up to me on here!    Cheers!

Oh my "trading" is at most about 2% of the portfolio.  I do it to keep - as Angela says - from living in the past.  I'm more never-sell than ever because of the things I've bought that I do not plan to sell.

It’s interesting that you reached such a conclusion based on the above e-mail.

 

I never cared about the Epstein stuff, before Trump, during Trump, now.  Never read or watched a thing about it.

 

Life’s a lot easier when you realise you don’t have to form an opinion about something, or rush to judgement.

 

However if you don’t think the Dems won’t try to spin even the slightest thing - which was kinda of my point - I wouldn’t call that TDS I’d start with naive.

That’s good journalism to spot the sleight of hand and correct for it.

Cubs, I think both you and I can agree that there is a very easy way to make the Dems look completely stupid and exonerate the President from any smear campaign...that would be to release the Epstein files completely unredacted.

For example, the email from Michael Wolff makes Wolff look like a complete cretin and asshole...but at the same time it clearly indicates Trump had been to the house lots of times.  Only releasing the whole thing will let people know exactly what went down.  Cheers!

Glad you're having fun - we went in Spring and was as joyful as I remembered as a kid, though I confess I shelled out for the queue jumps for the family as when you're coming from the UK, you're only doing it once!  Though the App can be a pain.

 

Was particularly wowed by Hollywood Studios which was new to me.

 

Anyway, enjoy the rest, and back to the politics...
