  1. I think it is more of an emotional overrun at this point. Anything has bright and dark side. When share prices go down, people look at the dark side more. When share prices go up, people look at the bright side more. I personally had the same feelings and almost wanted to sell a few weeks ago. Then I reminded myself to go back to the analytical framework and forget about emotions.
  2. I recommend reading (or re-reading) Chapter 8 of The Intelligent Investor. Do you think Benjamin Graham would have even invested in a company where government's hands are fully in the cookie jar? Where do you see this going? Mnuchin hasn't done anything and it appears that the bank lobby and fake news is victorious in all of this. I don't know why Berkowitz, Ackman and Paulson aren't doing more. The more time slips, the less this could be resolved in my opinion. Courts are highly political as we know and the appeals court decision is a black mark on justice system as it was completely political. Buffet once had a special situation play where the US government took control over a piece of land that the company owns and declared it as national park. It was also a lawsuit bet and he won in the end. Can't remember where I saw that and what that stock was. Probably in the Buffet annual letters?

Some mention of Trump lack of support in statement, then crash. OK. We will see if it shows up in today's GSELinks. Sometimes these rumors are setup by the big boys so they can load up. I remember when the Fiat Chrysler merger was announced, on that same day WSJ came up with 7 hit pieces on the front page for FCAU. The stock price now is way higher than then.

  11. Where did you see that in this filing? All this filing says is that it dropped support for FHFA. BTW, could this imply that Mnuchin and Watt don't get along? Otherwise FHFA could have just filed that they don't think they are constitutional either. What I observed is that this country seems more divided after the election and all Democrats would oppose ANYTHING the Republican says, without any rational thinking.

  15. I thought the article was about SHLD until I read through it. I bought SHLD in 2013 and thanks to his SHLD article, there was a huge short squeeze that helped me get out safely. I'd remember this guy forever. One lesson is that if you have a big position, you HAVE to cut your losses quickly if the position doesn't go in your direction immediately.

  22. Not sure why en banc is a good strategy. The whole appeals panel has 17 D and 4 R. Do you expect them to rule in plantiffs favor? it will be a good strategy if the new DOJ takes a different position... We haven't seen that change of attitude yet from their responses to the Fairholme case. I hope things will start to change soon.

  24. Could it be that Lamberth later rules that there is contractual claims and it is worth $0.01 a share. Then in the taking court the defense lawyer argues that the contractual claims have already been awarded so there is no taking. I am not a lawyer. Just trying to understand how the government can have it both ways.
